Stop Covering Up And Kill The CRA
Regulation: The Community Reinvestment Act is to blame for the financial crisis, but it so powerfully serves Democrats' interests that they'll do anything to protect it — including revising history.
The CRA coerces banks into making loans based on political correctness, and little else, to people who can't afford them. Enforced like never before by the Clinton administration, the regulation destroyed credit standards across the mortgage industry, created the subprime market, and caused the housing bubble that has now burst and left us with the worst housing and banking crises since the Great Depression.
The CRA should be abolished, along with the government-sponsored enterprises that fueled the secondary market for subprimes — under pressure from Clinton, who ordered HUD to set quotas for "affirmative action" lending at Fannie Mae and Freddie Mac.
But powerful Democrats in Washington want to protect the act — along with Fannie and Freddie — and spin the subprime scandal as the result of too little regulation, not too much.
"Repealing or weakening the CRA would be a mistake," warns Senate Banking Committee Chairman Chris Dodd, D-Conn., who argues that the CRA should be strengthened.
Dodd, the top recipient of Fannie donations and himself a beneficiary of a sweetheart mortgage brokered by a subprime lender, recently invited one of Clinton's top enforcers of the CRA to testify.
"The notion that CRA has caused this problem is a pernicious thought," said former Comptroller of the Currency Gene Ludwig. "These are not truthful statements. The CRA has helped to create a better and sounder world for finance, not the opposite."
Dead wrong. But the mainstream media believe it, and have attacked those, including this paper, who dare to tell the truth about the crisis. Already the debacle has erased $13 trillion in wealth, while putting taxpayers on the hook for up to $8 trillion in bailouts.
"The latest salvo from conservatives began via a Sept. 15 editorial in Investor's Business Daily, titled 'The Real Culprits In This Meltdown,' " grumbled a column distributed by Scripps Howard News Service. "Its editorial blamed President Clinton for today's mess."
As we said, Clinton beefed up the CRA and used it to force banks to subsidize poor communities with close to $1 trillion in high-risk loans and other commitments that flouted underwriting rules.
Yet, somehow, these media-driven myths keep getting in the way of actual facts, such as:
Fact: The 1977 law was only lightly enforced until Clinton added teeth to it in 1994 and launched an anti-redlining campaign against banks, led by Ludwig, Housing Secretary Henry Cisneros (and later Andrew Cuomo) and Attorney General Janet Reno that lasted into this decade.
Minority homeownership rates, which had been flat, began a steep rise in 1995, and home prices soon followed, stoked by easier lending. Numerous bank officials complain that they still feel pressured by CRA regulators to make inner-city loans they know are at great risk of defaulting.
Myth: The CRA could not have led to financial Armageddon, because the overwhelming share of subprime mortgages came from lenders that were not banks and not regulated by the CRA.
Fact: Nearly 4 in 10 subprime loans between 2004 and 2007 were made by CRA-covered banks such as Washington Mutual and IndyMac. And that doesn't include loans made by subprime lenders owned by banks, which were in effect covered by the CRA.
Last year, when the bubble burst, bank subprime loans totaled $142 billion, dwarfing those made by lenders.
What's more, the biggest subprime lender, Countrywide, while not subject to the law, still came under federal pressure to make risky loans in minority communities.
Clinton created a separate department at HUD to police "fair lending" at Fannie and Freddie and also at lenders like Countrywide, which became Fannie's biggest client. In 1994, Countrywide became the nation's first mortgage lender to sign with HUD a "Declaration of Fair Lending Principles and Practices."
As a result, Countrywide made more loans to minorities than any other lender — and not surprisingly, was one of the first lenders swamped by loan defaults.
Other lenders felt the heat from Reno's Justice Department, which prosecuted them for failing to operate enough branches in black neighborhoods. Reno put the entire banking industry on notice about the CRA and her enforcement program.
Myth: The CRA did not force anyone to do subprime loans or take excessive risks.
Fact: Subprime loans were the vehicle banks used to satisfy CRA compliance, and Clinton and his regulators encouraged their use. Before Clinton took office, subprimes were virtually unheard of. By the time he left, they made up more than 9% of the market for mortgage originations. Today they're 20%.
"It's instructive to go back to the early stages of the subprime market, which has essentially emerged out of the CRA," ex-Fed chief Alan Greenspan said in recent testimony on the roots of the crisis.
Clinton pushed banks to grant mortgages to minorities with poor credit by using "flexible" underwriting standards — or risk being branded racist. Rules were weakened to the point where welfare and unemployment checks were accepted as qualifying income.
Myth: Greedy investment bankers, who securitized and sold subprime mortgages, drove us to the credit crisis, not government.
Fact: Clinton's regulatory policies led to the creation of this new risk on Wall Street. His CRA amendments created the subprime market, and only after he pressured Fannie and Freddie to socialize the risk and guarantee the profit from the subprime loans did Wall Street get involved in a big way.
The exotic securitizations that have gotten so much of the blame were a symptom, not the cause, of the crisis.
The architects of the crisis want to divert attention from their own culpability by blaming the markets rather than their own regulations mandating that banks make high-risk loans based on race.
In fact, regulations had almost everything to do with this mess. And instead of strengthening them to atone for the alleged "sins of capitalism," we should be abolishing them.
Two bills in the House would be a good place to start. HR 7264, which has nine co-sponsors, would repeal the CRA. And HR 7094, with 17 co-sponsors, would dissolve Fannie Mae and Freddie Mac.
During the last severe slump, President Reagan deregulated the economy, saying: "Government is not the solution to the problem; government is the problem." He's as right today as he was then.

In the old days — from the Venetian Republic to, oh, the Bear Stearns rescue — if you wanted to get rich, you did it the Warren Buffett way: You learned to read balance sheets. Today you learn to read political tea leaves.
You don't anticipate Intel's third-quarter earnings; instead, you guess what side of the bed Henry Paulson will wake up on tomorrow.
Today's extreme stock market volatility is not just a symptom of fear — fear cannot account for days of wild market swings upward — but a reaction to meta-economic events: political decisions that have vast economic effects.
As economist Irwin Stelzer argues, we have gone from a market economy to a political economy. Consider seven days in November.
On Tuesday, Nov. 18, Paulson broadly implies that he's only using half the $700 billion bailout money. Having already spent most of his $350 billion, he's going to leave the rest to his successor. The message received on Wall Street — I'm done, I'm gone.
Facing the prospect of two months of political limbo, the market craters. Led by the banks (whose balance sheets did not change between Tuesday and Wednesday), the market sees the largest two-day drop in the S&P since 1933, not a very good year.
The next day (Friday) at 3 p.m., word leaks of Timothy Geithner's impending nomination as Treasury secretary. The mere suggestion of continuity — and continued authoritative intervention during the interregnum by the guy who'd been working hand in glove with Paulson all along — sends the Dow up 500 points in one hour.
Monday sees another 400-point increase, the biggest two-day (percentage) rise since 1987. Why?
Three political events: Paulson's weekend Citigroup bailout; the official rollout of Obama's economic team, Geithner and Larry Summers; and Paulson quietly walking back from his earlier de facto resignation by indicating that he would be ready to use the remaining $350 billion (with Team Obama input) over the next two months.
Lobby For Life
That undid the market swoon — and dramatically demonstrated how politically driven the economy has become.
We may one day go back to a market economy. Meanwhile, we need to face the two most important implications of our newly politicized economy: the vastly increased importance of lobbying and the massive market inefficiencies that political directives will introduce.
Lobbying used to be about advantages at the margin — a regulatory break here, a subsidy there. Now lobbying is about life and death. Your lending institution or industry gets a bailout — or it dies.
You used to go to New York for capital. Now Wall Street, broke, is coming to Washington. With unimaginably large sums of money being given out by Washington, the Obama administration, through no fault of its own, will be subject to the most intense, most frenzied lobbying in American history.
That will introduce one kind of economic distortion. The other kind will come from the political directives issued by newly empowered politicians.
First, bank presidents are gravely warned by one senator after another about "hoarding" their bailout money. But hoarding is another word for recapitalizing to shore up your balance sheet to ensure solvency.
Schumer-Mobiles
Is that not the fiduciary responsibility of bank directors? And isn't pushing money out the window with too little capital precisely the lending laxity that produced this crisis in the first place? Never mind. The banks will knuckle under to the commissars of Capitol Hill. They control the purse. Prudence will yield to politics.
Even more egregious will be the directives to a nationalized Detroit. Sen. Charles Schumer, the noted automotive engineer, declared "unacceptable" last week "a business model based on gas." Instead, "We need a business model based on cars of the future, and we already know what that future is: the plug-in hybrid electric car."
The Chevy Volt, for example? It has huge remaining technological hurdles, gets 40 miles on a charge and will sell for about $40,000, necessitating a $7,500 outright government subsidy. Who but the rich and politically correct will choose that over a $12,000 gas-powered Hyundai?
The new Detroit churning out Schumer-mobiles will make the steel mills of the Soviet Union look the model of efficiency.
The ruling Democrats have a choice: Rescue this economy to return it to market control. Or use this crisis to seize the commanding heights of the economy for the greater social good. Note: The latter has already been tried. The results are filed under "History, ash heap of."

Micromanagers Draw A Bead On CEO Pay
There is an old Russian fable, with different versions in other countries, about two poor peasants, Ivan and Boris. The only difference between them was that Boris had a goat and Ivan didn't.
One day, Ivan came upon a strange-looking lamp and, when he rubbed it, a genie appeared. She told him that she could grant him just one wish, but it could be anything in the world. Ivan said, "I want Boris' goat to die."
Variations on this story in other countries suggest that this tells us something about human beings, not just Russians. It may tell us something painful about many Americans today, when so many people are preoccupied with the pay of corporate CEOs.
It is not that the corporate CEOs' pay affects them so much. If every oil company executive in America agreed to work for nothing, that would not be enough to lower the price of a gallon of gasoline by a dime. If every General Motors executive agreed to work for nothing, that would not lower the price of a Cadillac or a Chevrolet by 1%.
Too many people are like Ivan, who wanted Boris' goat to die.
It is not even that the average corporate CEO makes as much money as any number of professional athletes and entertainers. The average pay of a CEO of a corporation big enough to be included in the Standard & Poor's index is less than one-third of what Alex Rodriguez makes, about one-tenth of what Tiger Woods makes and less than one-30th of what Oprah Winfrey makes.
But when has anyone ever accused athletes or entertainers of "greed"?
It is not the general public that singles out corporate CEOs for so much attention. Politicians and the media have focused on business leaders, and the public has been led along, like sheep.
The logic is simple: Demonize those whose place or power you plan to usurp. Politicians who want the power to micromanage business and the economy know that demonizing those who currently run businesses is the opening salvo in the battle to take over their roles.
There is no way that politicians can take over the roles of Alex Rodriguez, Tiger Woods or Oprah Winfrey. So they can make any amount of money they want and it doesn't matter politically.
Those who want more power have known for centuries that giving the people somebody to hate and fear is the key.
In 18th-century France, promoting hatred of the aristocracy was the key to Robespierre's acquiring more dictatorial power than the aristocracy had ever had, and using that power to create a bigger bloodbath than anything under the old regime.
In the 20th century, it was both the czars and the capitalists in Russia who were made the targets of public hatred by the Communists on their road to power. That power created more havoc in the lives of more people than czars and capitalists ever had combined.
As in other countries and other times, today it is not just a question of which elites win out in a tug of war in America. It is the people at large who have the most at stake.
We have just seen one of the biggest free home demonstrations of what happens in an economy when politicians tell businesses what decisions to make.
For years, using the powers of the Community Reinvestment Act and other regulatory powers, along with threats of legal action if the loan-approval rates varied from the population profile, politicians have pressured banks and other lending institutions into lending to people they would not lend to otherwise.
Yet, when all this blows up in our faces and the economy turns down, what is the answer? To have more economic decisions made by politicians, because they choose to say that "deregulation" is the cause of our problems.
Regardless of how much suffocating regulation may have been responsible for an economic debacle, politicians have learned that they can get away with it if they call it "deregulation."
No matter what happens, for politicians it is "heads I win and tails you lose." If we keep listening to the politicians and their media allies, we are all going to keep losing, big time. Keeping our attention focused on CEO pay — Boris' goat — is all part of this game. We are all goats if we fall for it.

The first thing a new player needs to know is that when someone loses The Game (i.e. when someone thinks about The Game), game play temporarily stops for that person and for those around that person (since he must announce his game-loss aloud). The Game then restarts on a person-by-person basis when each person stops thinking about The Game.
The Game never actually ends permanently.
No one wins!
No one can ever technically win The Game. It could be argued that when one is not losing The Game (i.e. when someone is not thinking about The Game), they are winning The Game, but it still holds true that no one can ever definitively win The Game.
You probably still don't understand The Game and how to play, so consider the example below.
Example You have just learned the rules of The Game and how to play. Because you now know this, you are playing The Game, and will be playing The Game for the rest of your life. At this moment in time you are thinking about The Game, so you are losing The Game. Let's say you leave this site, start doing something else, and The Game leaves your mind. But then you start thinking about this site again and therefore you start thinking about The Game... that's a loss of The Game!
Keep in mind that it doesn't matter what makes you think of The Game. Usually it is something completely random and unrelated to The Game that all of a sudden reminds you of The Game. The bottom line Any time you aren't thinking about The Game and then start thinking about The Game, you lose The Game. It's that simple.

'A Day of Thanksgiving'
The national holiday actually began at a dark hour during our war for independence. Here's the story.
When was the first Thanksgiving? Most of us think of the Pilgrims at Plymouth in 1621. But if the question is about the first national Thanksgiving holiday, the answer is that the tradition began at a lesser-known moment in 1777 in York, Pa.
In July 1776, the American colonists declared independence from Britain. The months that followed were so bleak that there was not much to give thanks for. The Journals of the Continental Congress record no Thanksgiving in that year, only two days of "solemn fasting" and prayer.
For much of 1777, the situation was not much better. British troops controlled New York City. The Americans lost the strategic stronghold of Fort Ticonderoga, in upstate New York, to the British in July. In Delaware, on Sept. 11, troops led by Gen. George Washington lost the Battle of Brandywine, in which 200 Americans were killed, 500 wounded and 400 captured. In Pennsylvania, early in the morning of Sept. 21, another 300 American soldiers were killed or wounded and 100 captured in a British surprise attack that became known as the Paoli Massacre.
Philadelphia, America's largest city, fell on Sept. 26. Congress, which had been meeting there, fled briefly to Lancaster, Pa., and then to York, a hundred miles west of Philadelphia. One delegate to Congress, John Adams of Massachusetts, wrote in his diary, "The prospect is chilling, on every Side: Gloomy, dark, melancholy, and dispiriting."
His cousin, Samuel Adams, gave the other delegates -- their number had dwindled to a mere 20 from the 56 who had signed the Declaration of Independence -- a talk of encouragement. He predicted, "Good tidings will soon arrive. We shall never be abandoned by Heaven while we act worthy of its aid and protection."
He turned out to have been correct, at least about the good tidings. On Oct. 31, a messenger arrived with news of the American victory at the Battle of Saratoga. The American general, Horatio Gates, had accepted the surrender of 5,800 British soldiers, and with them 27 pieces of artillery and thousands of pieces of small arms and ammunition.
Saratoga turned the tide of the war -- news of the victory was decisive in bringing France into a full alliance with America. Congress responded to the event by appointing a committee of three that included Samuel Adams, Richard Henry Lee of Virginia and Daniel Roberdeau of Pennsylvania, to draft a report and resolution. The report, adopted Nov. 1, declared Thursday, Dec. 18, as "a day of Thanksgiving" to God, so that "with one heart and one voice the good people may express the grateful feelings of their hearts, and consecrate themselves to the service of their divine benefactor."

A year later, Gov. Adams offered a similar Thanksgiving proclamation, declaring Thursday, Dec. 15, 1796, as "a Day of Public Thanksgiving and Praise to Our Divine Benefactor." The wrong folks were in the witness chairs in last week's congressional hearings on auto doom. A fantastic moment was Massachusetts Rep. Stephen Lynch assailing Rick Wagoner about whether GM was asking China for a bailout too. The implication seemed to be that GM can't afford its inflated UAW pay packages because it's squandering money to build cars in China.
Mr. Wagoner mildly answered that GM's China operations are profitable. They actually help to underwrite the massive losses in the U.S.

ILLEGAL IMMIGRANTS
Of course, such a comment would not get so much media attention: people are too busy fawning over Barack Obama and adding halos to his head on the covers of their magazines. And, don't forget the fact that Obama essentially mirrors what amounts to sanctuary by giving illegal immigrants drivers licenses. What better a way to welcome an illegal immigrant to the country than by giving them an ID which enables them to do anything they want to do (yet does not give them the burden of paying taxes towards any of the services they will be consuming).At the end of the day the larger media will avoid the immigration issue as much as possible because it is the place that Democrats drift off so far from the realm of common sense and basic reason it can quickly become as embarrassing as all the Mexican flags at an illegal immigration amnesty rally.

God Help Him, But Area Man Loves That Crazy Bitch
RENO, NV—Despite her continued efforts to drive him out of his goddamn mind and turn his every waking hour into some kind of living nightmare, Craig Shearer, 32, admitted Monday that he still loves that crazy bitch.
"Aw, who am I kidding? That nut-job's really got my number," Shearer told reporters after being locked out of the apartment he shares with the total psycho. "She may not give me a moment's peace and I can't mention another woman's name without hearing about it for a week, but what can I do? She's the one. That fucking lunatic is the one."
Shearer then concluded his address, sighed, and began gathering his shirts and pants from his front lawn.
Shearer's proclamation of love for that big sack of crazy comes in direct contradiction to a statement he made at the Loading Dock nightclub last week. After getting into an argument with his girlfriend over not taking her computer classes seriously enough, Shearer was reportedly thrown out of the bar at the request of the fucking basket case, who just five minutes later assaulted the bouncer for "getting in her business" and was thrown out herself.
During the intervening minutes, Shearer made a number of public statements regarding his girlfriend's unstable mental health, fluctuating emotions, and irritating pine-nut allergy before reconciling with the bat-shit insane woman in the backseat of their car.
Although Shearer has tried multiple times to leave that crazy bitch once and for all, he has thus far been unsuccessful. His most recent attempt came shortly after she arrived at his office sobbing over the death of her seventh straight pet parakeet, but was ultimately delayed when Shearer couldn't imagine his life without the raving sociopath.

Friends said they have seen the couple go through many difficult times in years past, including that night when the crazy bitch had a little bit too much to drink and accused Shearer of hiding money from her, and that incident, a few weeks back, when she locked herself inside the bathroom and refused to come out until Shearer had thrown away the casserole she cooked, like she knew he wanted to. Still, sources confirmed that Shearer and his old lady always seem to work things out in the end, a trend that may suggest those crazy fucks are perfect for each other.
"If my girlfriend wrote 'limp dick' in permanent marker on all my work shirts because I said Kate Winslet was hot, I'd probably leave her," Shearer's longtime friend James Pennette said. "But Craig? Man, does he have it bad for that crazy bitch."
